Service Agreement

QUICK SUMMARY: You understand we're not lawyers and don't provide legal advice. This video is an educational tool only. You're responsible for your clients and their testimony. All sales are final. You can share this video with unlimited clients, but you can't redistribute or resell it.

THE FULL DETAILS:

This Service Agreement ("Agreement") is made between Haus Team Productions / Trial Haus Consulting ("Service Provider") and the Purchaser ("Client") for the purchase and use of The Essential Witness Prep Starter Video ("The Video"). The Client will identify themselves through the online purchase/checkout form.

Product Description

The Service Provider offers a pre-recorded educational video product designed to help prepare first-time witnesses for giving testimony. The Video is approximately 14 minutes in length and provides fundamental guidance on testifying effectively. The Video is intended as an educational resource that attorneys may share with their clients prior to testimony.

License Grant and Usage Rights

Upon purchase, the Client receives a non-exclusive, non-transferable license to use The Video for the following purposes:

- The Client may share The Video with an unlimited number of their own clients for witness preparation purposes.

- The Video may be viewed by the Client's clients, staff, and colleagues within the Client's law practice.

- The Video is licensed for internal use within the Client's legal practice only.

The Client may NOT:

- Resell, redistribute, or sublicense The Video to third parties.

- Share The Video with other law firms or legal professionals outside the Client's practice.

- Use The Video for any commercial purpose beyond preparing the Client's own clients for testimony.

- Edit, modify, or create derivative works based on The Video.

- Remove or alter any copyright notices, watermarks, or proprietary information contained in The Video.

Ownership of Materials

The Video and all associated content, materials, and intellectual property remain the sole and exclusive property of Haus Team Productions / Trial Haus Consulting. The Client acknowledges that this is a license agreement and that no ownership rights are transferred through this purchase.

No Guarantees of Testimony Outcomes

The Client acknowledges that the Service Provider does not guarantee any specific outcomes resulting from witnesses viewing The Video or applying concepts presented in The Video. The effectiveness of witness testimony depends on numerous factors including the witness's individual characteristics, the nature of the case, the witness's preparation beyond this video, and circumstances beyond the Service Provider's control.

No Legal Advice Provided

The Client understands that the Service Provider is not a law firm, does not provide legal advice, and is not a substitute for an attorney. The Video provides general educational content about testifying and communication, not legal counsel specific to any particular case, jurisdiction, or legal matter. The Client remains solely responsible for all legal strategy, preparation, and counsel provided to their clients.

Specialization Confirmation

The Client confirms that their law practice specializes in Plaintiff's law, criminal defense, or family law. By purchasing The Video, the Client acknowledges that the content is tailored to these areas of legal practice.

Refund Policy

All sales are final. No refunds will be provided after purchase for any reason. By completing the purchase, the Client acknowledges and accepts this no-refund policy.

Waiver of Liability

The Client hereby releases, waives, and discharges the Service Provider, its affiliates, employees, agents, and representatives from any and all liability, claims, and demands arising out of or related to any loss, damage, or injury, including but not limited to any economic or non-economic losses, that may be sustained by the Client or the Client's clients as a result of using The Video or applying concepts presented in The Video.

The Client acknowledges that:

- The Client is solely responsible for the preparation and performance of their clients as witnesses.

- The Service Provider bears no responsibility for testimony outcomes, case results, or any consequences arising from witness testimony.

- The Video is one educational tool among many, and the Client maintains full professional responsibility for witness preparation.

Assumption of Risk

The Client expressly assumes all risks associated with using The Video and applying its concepts in legal practice, whether foreseen or unforeseen. The Client hereby releases, waives, discharges, and covenants not to sue the Service Provider, its officers, employees, agents, representatives, or other associated persons from any and all liabilities, claims, actions, damages, costs, or expenses of any nature whatsoever arising out of or in any way connected with the Client's use of The Video or their clients' testimony.

Attorney-Client Privilege and Confidentiality

The Service Provider acknowledges that the Client is an attorney or representative of a legal practice, and that certain attorney-client privileges and confidentiality protections apply to the Client's work with their clients.

The Service Provider respects and upholds all attorney-client privileges and confidentiality protections that exist between the Client and their clients, as provided by law. The Video is provided as a tool for the Client's use within their confidential attorney-client relationships.

The Client is solely responsible for determining when, how, and with whom to share The Video, and for ensuring that such sharing complies with all applicable rules of professional conduct and confidentiality obligations.

Indemnification

The Client agrees to indemnify, defend, and hold harmless the Service Provider and its affiliates, employees, agents, and representatives from and against any and all claims, liabilities, damages, and expenses (including reasonable attorney's fees) arising out of or in connection with:

- Any breach of this Agreement by the Client.

- Any unauthorized use, distribution, or modification of The Video.

- Any claims arising from the Client's clients' testimony or case outcomes.

- Any violation of the license restrictions outlined in this Agreement.

Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising under or in connection with this Agreement shall be resolved in the courts of San Diego County, California.

Acknowledgment

The Client acknowledges that they have read this Agreement and fully understand its terms. The Client understands that they are giving up substantial rights, including the right to sue. The Client acknowledges that they are agreeing to this Agreement freely and voluntarily, and intend by their acknowledgment to be a complete and unconditional release of all liability to the greatest extent allowed by law.

The Client specifically acknowledges:

- They understand this is a digital product with no refunds.

- They understand the license restrictions and will not redistribute or resell The Video.

- They understand they are solely responsible for their clients' testimony and case outcomes.

- They understand the Service Provider provides no legal advice and makes no guarantees.

Entire Agreement

This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, or representations, whether written or oral.

Amendments

This Agreement may only be amended or modified by a written agreement signed by both parties.

By completing the purchase/checkout process, the Client acknowledges that they have read, understood, and agree to be bound by the terms and conditions of this Service Agreement.
